Terms and Conditions

1. Scope of the contract

1.1. These Terms and Conditions apply to all purchase agreements concluded by Preiser Records GmbH (FN 111898g; hereafter referred to as: PREISER RECORDS) in the PREISER RECORDS online shop.

2. Conclusion of purchase agreements

2.1. The introduction of articles on the PREISER RECORDS online shop is a non-binding invitation to the public to place an order. The customer’s order is a binding offer.

2.2. PREISER RECORDS is free to accept or decline the customer’s offer. This applies in particular in case of price changes, possible mistakes or technical errors in the online shop, on sales prospectuses, price lists or other advertising materials.

2.3. Immediately after receiving the order, PREISER RECORDS shall send the customer an order confirmation containing all important information on the order, in particular the delivery and billing address, the number and individual price of the ordered articles and the transport costs as well as the total price. The order confirmation serves the customer as a confirmation receipt for the order, but is not yet an acceptance notice.

2.4. The order is accepted at PREISER RECORDS’ discretion within 14 days from receiving the order by sending an acceptance notice per email or, should delivery be possible within this period, immediately after sending the ordered articles.

2.5. Should PREISER RECORDS, as an exception, not send an acceptance notice within this period or send the articles to the customer, the binding period shall be considered expired and the purchase agreement not concluded.

3. Shipping costs, shipping periods and shipping conditions

3.1. All prices indicated in the PREISER RECORDS online shop are net prices since the value-added tax, possible customs and delivery costs depend on the billing/delivery address and are thus calculated and presented after placing the order.

3.2. Until further notice, the following delivery costs apply:

3.3. Articles marked as in stock in the PREISER RECORDS online shop are usually shipped within two to three working days.

3.4. Should the articles be shipped separately in two or more shipments, no further costs shall arise for the customer.

3.5. Articles are shipped by mail or parcel service at PREISER RECORDS’ discretion.

4. Billing, payment, reservation of ownership

4.1. The prepayment of the invoiced amount (by using one of the payment systems offered on this website) is required for the execution of an order and the shipment of the articles.

4.2. The articles shall remain the property of PREISER RECORDS up to the full payment and the customer is not allowed to transfer, pledge or otherwise confer rights on the articles to third parties.

5. Warranty and compensation

5.1. The customer is entitled to statutory guarantee claims pursuant to Chapters 922 ff of the Austrian Civil Code (ABGB).

5.2. PREISER RECORDS shall be exempt from liability for material damage caused by slight negligence or pure financial damage.

5.3. To be able to assert claims against the carrier, the customer is obligated to check the articles upon reception and indicate any damage (including an eventual damage to the packaging) to the delivery agent and to write it down on the confirmation form.

6. Special provisions for consumers

6.1. Consumers as described in the Austrian Consumer Protection Law (KSchG) are generally entitled to withdraw from a contract. See the cancellation policy for more details.

6.2. As an exception, consumers do not have a withdrawal right for distance contracts for sound or video recordings shipped in a sealed packaging if the sealing has been removed after delivery.

7. Final provisions

7.1. These Terms and Conditions and all purchase agreements concluded by PREISER RECORDS are exclusively subject to Austrian law under exclusion of the referral norms and UN commercial law.

7.2. There are no ancillary agreements; any existing ancillary agreements shall cease to be valid upon completion of these Terms and Conditions or of a purchase agreement.

7.3. In the case of inconsistency between the present Terms and Conditions and the purchase agreement, the purchase agreement shall prevail on the Terms and Conditions.

7.4. The place of fulfilment is Vienna.

7.5. Changes and additions to the present Terms and Conditions must be made in writing. This also applies to renouncing the written form requirement.

7.6. The exclusive place of jurisdiction for disputes arising from or in connection with the present Terms and conditions or a purchase agreement is the competent court in charge of commercial judiciary for the first district of Vienna.

7.7. Should the customer be a consumer, then all mandatory provisions under the law of the State in which the consumer is ordinarily resident shall apply.
